Protect Electricity Consumers From Service Disconnection

AKO BICOL PARTY-LIST
REP. ALFREDO A. GARBIN, JR.
Vice-Chair, Committee on Justice
09177292437 | Twitter @AlfredoGarbin

ERC ASKED TO TAKE A SECOND LOOK AT SUFFERING OF HOUSEHOLDS, BUSINESSES

I commend the ERC for its swift action on our appeal to protect electricity consumers from service disconnection although the ERC order covers only households consuming not more than 200 kilowatt-hours per month and is only up to December 31 this year.

I asked for no disconnection coverage up to January 31, 2021 for all households and small businesses.

ERC can take a second look at the situation on the ground. Electricity bills are aggravating the suffering of families and enterprises. They must be allowed recover so our country can recover.

I ask ERC Chairperson Agnes Devanadera and her Commissioners to consider this alternative: For those with better financial means or over 200 kwh per month electricity consumption, staggered payments across four months and suspended disconnection while during the installment payment period.

For areas devastated by typhoons, electricity consumers must not suffer service disconnection.

Water utilities firms nationwide should also be compassionate to their customers. (END)

Pope Francis Promotes Demonic Same-Sex Marriage

REP. JOCELYN P. TULFO
ACT-CIS Party-list
Member, Committee on Social Services
https://www.facebook.com/jocelyntulfoinaction/ | 09177292437

COMPARISON TABLE (SEE ATTACHED FILE)

SIMPLENG PARTNERSHIP CONTRACT

(END)

Sec. Cusi Reminds the Energy Sector to Prepare for TD Pepito

DOE Sec. Cusi Reminds the Energy Sector to Prepare for TD Pepito

TAGUIG CITY – Department of Energy (DOE) Secretary Alfonso G. Cusi is reminding the entire energy family to prepare for Tropical Depression (TD) Pepito, which may intensify into a Tropical Storm before making landfall over the Isabela-Aurora area or the Aurora-Northern Quezon area tomorrow evening (20 October) or early Wednesday morning (21 October).

The Energy Secretary emphasized the importance of strengthening the energy sector's disaster risk preparedness and response capabilities, especially since the country is visited by an average of 20 tropical cyclones per year.

The DOE-led Task Force on Energy Resiliency (TFER) had already begun to monitor and alert its members and stakeholders.

Energy facilities situated along the path of TD Pepito were reminded to activate their respective action/contingency plans, while taking into consideration the current COVID-19 pandemic.

Secretary Cusi likewise reminded all power assets, specifically those located within the projected track of the TD to closely monitor the situation and coordinate with the concerned government agencies and local government units.

With regard to the downstream oil sector, the Energy chief asked oil companies to secure the prescribed fuel inventory levels, and protect consumers against delays in the delivery of energy services, most especially in areas heavily dependent on gasoline and diesel for their daily activities.

Secretary Cusi would like to remind the public to immediately report any incidents concerning power supply facilities, and to practice the following E-Safety tips:

•Charge flashlights and mobile phones

•Be informed on the latest news updates

•Switch-off circuit breakers and other electrical systems to avoid electrocution, among other electrical mishaps

•After the typhoon, check electrical systems prior to using to avoid short circuits

"With the current pandemic, we must do all we can to prevent another disaster from happening. We could do this by remaining vigilant in our preparedness efforts. For the energy sector, this entails securing our energy facilities so they remain operational before, during, and even after the storm," Secretary Cusi concluded.

Aboitiz represents the Philippines in APEC food security meeting

Aboitiz represents the Philippines in APEC food security meeting
Initiative mirrors Aboitiz Group's active involvement in national and regional food security

Tristan R. Aboitiz, President of Aboitiz food business unit Pilmico Foods Corporation, was one of three Philippine representatives tasked to represent the country's interests and concerns at the recent 16th Asia Pacific Economic Cooperation Policy Partnership on Food Security (APEC PPFS) Meeting.

Aboitiz joined 19 other PPFS representatives last October 15, 2020 in the virtual meeting, which carried the theme "Optimising Human Potential Toward A Resilient Future Of Shared Prosperity."

"Food security remains to be an urgent priority of the region's economies, especially during the current COVID-19 (Coronavirus Disease 2019) pandemic. Pilmico is a major part of the Philippine and regional food industry, being at the beginning of the food value chain, and we are honored to join this meeting to signify the Aboitiz Group's contribution to helping ensure food security, not just in the Philippines, but in the region as a whole," Aboitiz said.

Pilmico, previously solely a national player, completed its entry into the regional food and agribusiness sector with Pilmico International's acquisition of a 100% stake in food firm Gold Coin in May 2019.

The APEC PPFS meeting's agenda included COVID-19 and Food Security Policy in the Asia-Pacific, Review of the Food Security Roadmap and Ministerial Statement on Food Security, and Reports by Food Security-Related Working Groups and Fora.

The APEC PPFS was established in 2011 to strengthen public-private cooperation to address food security issues in the region.

The ministers of APEC economies responsible for agriculture and food met for the first time in Niigata, Japan, in 2010 and issued the Niigata Declaration on APEC Food Security—the first comprehensive APEC plan for promoting regional food security.

Subsequent APEC ministerial meetings on food security were held biennially in Kazan, Russia (2012), Beijing, China (2014), and Piura, Peru (2016), which led to the Kazan Declaration, the Beijing Declaration, and the Piura Declaration which outline APEC's new plans for tackling food security.

PPFS members are expected to contribute input to policies on ensuring food security for APEC economies, as well as on any pressing problems within countries or regions that would require collaboration between organizations.

Pilmico is a strong proponent of food security. Last August 13, Pilmico signed a Memorandum of Agreement with the Department of Agrarian Reform (DAR) to provide livelihood and technical support services to Agrarian Reform Beneficiaries (ARBs).

Dubbed "The PaSSOver: ARBOld Move for Deliverance of our Farmers from the COVID-19 Pandemic," the DAR-funded initiative will enable 1,200 women ARBs to engage in livelihood activities in the agribusiness sector. Beneficiaries will be given starter kits for bakery training, egg layering and poultry or broiler production, hog fattening, and other similar livestock rearing businesses.

Aside from assistance to ARBs, Pilmico also donated a total of 655,000 pieces of bread to poor communities nationwide as daily sustenance from March to June 2020, some of the most critical periods of the extended community quarantine.

Currently, Pilmico's main commitment to Asia's food security is remaining fully operational amid the pandemic. Its plants, farms, and meat facilities continue to operate business as usual. It consistently implements strict biosecurity measures to ensure everyone's safety and echoes the Philippine government's assertion on sufficient food supply amid restrictions and uncertainties caused by the COVID-19 pandemic. - (Press Release)

Fugitive Murder Suspect in Kidapawan Radioman Killing joins ranks of Communist Terrorist Group

Press Release from Presidential Task Force on Media Killings:
PTFoMS Update: 16 October 2020

Fugitive Murder Suspect in Kidapawan Radioman Killing joins ranks of Communist Terrorist Group

In a desperate attempt to evade justice for the killing of Brigada News FM – Kidapawan station manager Eduardo Sanchez Dizon, the Presidential Task Force on Media Security (PTFoMS) has confirmed that prime suspect Dante Encarnacion Tabusares a.k.a. Bong Encarnacion has cowered behind the Communist Party of the Philippines – New People's Army (CPP-NPA) Terrorist group by joining its ranks in Arakan, North Cotabato.

This was verified in an official report submitted to the PTFoMS by the Armed Forces of the Philippines (AFP) through Captain Jonathan V Zata, Chief of the Public Affairs Office.

Acting on the Palace Task Force's directive to know the whereabouts of the fugitive, the AFP reported that Tabusares has been broadcasting communist propaganda in his previous program over a local FM station.

"I commend the AFP for its continuing support to the Task Force's initiatives in protecting the life, liberty and security of all our media workers in the country." said PTFoMS Co-Chair and Presidential Communications Operations Office (PCOO) Secretary Martin Andanar.

For his part, PTFoMS Exec. Dir. USec. Joel Sy Egco said, "Our suspicion has been confirmed. We received reports earlier this year that Encarnacion had joined the NPA as quickly as the warrant of arrest against him came out."

"The NPA today is nothing more than a coddler of criminals and fugitives from justice. Is this the kind of justice they are espousing? They are just a bunch of ruthless murderers. Tabusares may hide behind this communist terrorist group but we will make sure that he will not be able to evade the long arm of the law forever," the Palace official stressed.

It can be recalled that Judge Henelinda Molina-Diaz of Kidapawan Regional Trial Court (RTC) Branch 61 has ordered the arrest of Tabusares under Criminal Case no. 5281-2019 for the killing of Dizon, along with Junell Andagkit Poten and Sotelo Jacolbe, Jr.

Dizon, a former town councilor of Makilala, North Cotabato, was a blocktime host of the local Brigada News when murdered last July 10, 2019. He was driving his car on his way home to Makilala at past 10 p.m., when motorcycle "riding-in-tandem" gunmen opened fire on him and killed him on the spot.

Tabusares allegedly masterminded the ambush of Dizon, who was critical of the KAPA Community Ministry International in his commentaries. Tabusares was the local coordinator of KAPA at the time.

It was the PTFoMS that led the relatives of Dizon to file criminal cases against Tabusares, Poten and Jacolbe. Tabusares, the blocktimer endorser of KAPA and coordinator for its money market operations in Kidapawan City, threatened to have Dizon killed on his radio show weeks before the incident.

The PTFoMS is on top of the situation and will be relentless in bringing justice for Dizon and all other media workers who are victims of violence as a testament to the government's commitment to protect press freedom. ###

Oil Unbundling Circular

DOE STATEMENT ON THE COURT OF APPEALS' RULING UPHOLDING THE TAGUIG RTC'S ISSUANCE OF A WRIT OF PRELIMINARY INJUNCTION ON THE IMPLEMENTATION OF THE OIL UNBUNDLING CIRCULAR

Although the Court of Appeals' (CA) Decision on the matter was released through its website, the Department of Energy (DOE), through its counsel the Office of the Solicitor General, has yet to formally receive a copy of the Ruling. Once formally received, the DOE intends to seek a reconsideration of the Decision, and raise the issue to the Supreme Court, if necessary.

The DOE would like to emphasize that the CA ruled only on the issue of the validity of the trial court's issuance of a writ of preliminary injunction.

While the writ has prevented the DOE from implementing Department Circular (DC) DC2019-05-0008 on the unbundling of oil prices during the course of the case in the trial court, the CA Decision did not rule on the validity or invalidity of the DC.

The DOE considers the Circular vital as it believes in the objective of the law for the transparency of oil prices, at least to the government, in order to formulate better and more responsive oil industry policies. The DOE issued the Circular to help strengthen the agency's capability to monitor oil prices more effectively.

Moreover, the cases filed by the oil companies to nullify DC2019-05-0008 were based on the wrong notion that the supposed trade secrets they are being obligated to submit to the DOE wiill be divulged to the public. Time and again, the DOE has been stressing that all confidential information shall be kept strictly confidential.

The DOE maintains that the unbundling of oil prices would foster greater market transparency by establishing the trends in the prices of oil and finished petroleum products. This, in turn, would help ensure a level playing field within the oil industry, while upholding the best interests of consumers.

ERC Calls for Comments on the Proposed New RCOA Timeline

PRESS STATEMENT: ERC Calls for Comments on the Proposed New RCOA Timeline

The Energy Regulatory Commission (ERC), in a Notice issued pertinent to ERC Case No. 2020-002 RM in re:  Draft Resolution Prescribing the New Timeline for the Implementation of Retail Competition and Open Access (RCOA), sought comments from all interested parties on the proposed Resolution until 12 October 2020.  The first draft of the proposed Resolution aims to provide guidance on the implementation of the RCOA scheme, more particularly the updated timeline for the full implementation thereof.

"We are requesting all interested parties to submit their comments or inputs on the Draft Resolution Prescribing the New Timeline for the Implementation of Retail Competition and Open Access (RCOA) to ensure that we leave no stone unturned and ensure the seamless implementation of the RCOA", said ERC Chairperson and CEO Agnes VST Devanadera.

At present, RCOA is implemented in the Luzon and Visayas grids for the Phase I (1MW & up) and Phase II (750kW-999kW) contestable customers, on a voluntary basis.  The ERC's draft Resolution prescribes the time frames for the lowering of the threshold or the average monthly peak demand to cover end-users, as follows:

                           Threshold                             Level Effectivity
Phase III              500 kW to 749 kW               Feb. 26, 2021
Phase IV              100 kW to 499 kW               Jan. 26, 2022
Phase V               10 kW to 99 kW                   Jan. 26, 2023

End-users who meets the threshold level shall be allowed to contract with any licensed/authorized suppliers of electricity on a voluntary basis.

The RCOA shall be effective in grids where the Wholesale Electricity Spot Market (WESM) is operational.  All suppliers of electricity shall be licensed or authorized by the ERC to supply in the Competitive Retail Electricity Market (CREM).

Under the RCOA environment, the qualified Contestable Customer will be notified by the Network Service Providers of the former's ability or option to choose his electric service provider and may switch to his preferred Retail Electricity Supplier (RES).  Meanwhile, the Meter Service Provider (MSP) shall install the meter facilities that will measure the energy use and demand of the qualified contestable customer.  The MSP is the person or entity authorized by the ERC to provide metering services in the CREM.

"The benefits of the RCOA scheme will soon come to fruition despite the temporary setback that came up against its implementation.  The envisioned competition in the retail level of the supply sector will soon be a reality and the consuming public will be the beneficiaries of the RCOA as they can opt to choose the electricity provider that offers the most competitive price", Chair Devanadera added.

DOE and Development Partners Hold EE&C Forum for Luzon LGUs

JOINT MEDIA RELEASE
5 October 2020
DOE and Development Partners Hold EE&C Forum for Luzon LGUs

TAGUIG CITY - As part of continuing efforts to ensure the full implementation of Republic Act 111285 or the Energy Efficiency and Conservation Act of 2019 and its Implementing Rules and Regulations (IRR), the Department of Energy (DOE) and its development partners conducted the Luzon Energy Efficiency & Conservation (EE&C) Virtual Forum for Local Development on 1-2 October 2020. The online forum was the fourth and final event in the series aimed to propel local energy efficiency initiatives and inclusive development in throughout the country.

Signed into law by President Rodrigo Duterte on 12 April 2019, the EE&C Law and its IRR seek to secure the country's energy supply by making EE&C a national way of life.

In his keynote speech, DOE Senior Undersecretary Jesus Cristino P. Posadas urged local government units (LGUs) and co-workers in the government to become models in the responsible use of energy in order to effectively champion EE&C.

"Challenges persist, with COVID-19 being at the top of that list, but we must be committed towards a more sustainable and green future, not just for Luzon, but for the whole country," Usec. Posadas stressed.

Department of the Interior and Local Government Undersecretary Epimaco V. Densing III, who was also another keynote speaker, emphasized that "as public servants, we must maintain the balance of development and the preservation and conservation of our environment. The LGUs play a vital role in ensuring that provisions of the law are translated to local policies and appropriate strategies are implemented to ensure that energy efficiency and its benefits are felt throughout the country."

He also underscored the importance of having a sound energy efficiency framework "in ensuring a sustainable energy future, where our quest for development and discovery for new technologies shall not compromise our environment."

Meanwhile, EU Programme Manager for Energy Ms. Ileana Miritescu, in her opening remarks, emphasized that "the challenge to the energy sector is how to contribute to the collective efforts to 'Build Back Better' in response to this pandemic." She added that everyone needs to "transition to a new normal that makes use of our finite energy resources in the most efficient and effective way and reinforcing the multiple co-benefits of energy efficiency".

Among the highlights of the Forum was a presentation on the salient features of the EE&C Act and its IRR, conducted by DOE-Energy Utilization Management Bureau Director Patrick T. Aquino. He was also on hand during the Q&A to address questions raised by participants on the development of local energy plans, the obligations of designated establishments, certifications, incentives, rating and labeling requirements, minimum energy performance, demand side management, as well as the challenges and prohibited acts under the law.

On 30 September 2020, a pre-forum session to assist LGUs in completing the DOE's Local Energy Efficiency and Conservation Plan template was co-organized by World Wide Fund for Nature (WWF) Philippines, through its One Planet Cities Program. Atty. Gia Ibay, Head of Climate and Energy Programme and National Director of WWF-Philippines' Earth Hour, comprehensively explained how cities around the world are delivering their climate commitments through energy efficiency measures.

More than 250 local government executives, national government officials, financing institutions, private sector energy players and investors attended the Luzon EE&C Virtual Forum for Local Development, which was organized in partnership with the European Union-supported Access to Sustainable Energy Programme (EU-ASEP), the ASEP Clean Energy Living Laboratories, and the Asian Development Bank.

RANKING SOLON SLAMS GCASH, PAYMAYA FOR NOT HOLDING OFF E-PAYMENTS CHARGES TO UNTIL DEC. 31, 2020

I object to the decision of GCash and PayMaya to start charging their customers fees for use of PESONet and InstaPay e-payments mechanisms starting October 31.

These companies should rethink their decisions. During this pandemic crisis, especially in the areas still under MECQ and GCQ, every peso counts.

The other financial institutions opted to waive e-payment charges until December 31 this year. They made the prudent and compassionate decision.

P50.00, the maximum charge per transaction, can buy one kilo of rice and ingredients for one vegetable meal or about seven eggs.

For the poor, who have been using e-payments for the first time during this pandemic, the fees would be yet another disincentive to use e-payments. They would go back to have little or no

access to financial services. They will go back to being unbanked.

It is not yet too late for GCash and PayMaya to change their minds. (END)

Virtual Forum to Boost Luzon LGU Implementation

Virtual Forum to Boost Luzon LGU Implementation of the PH EE&C Law

TAGUIG CITY - The Department of Energy (DOE), in partnership with the European Union supported Access to Sustainable Energy Programme (EU-ASEP), ASEP-Clean Energy Living Laboratories, and the Asian Development Bank, will host the virtual Luzon Energy Efficiency and Conservation Forum for Local Development from 1 to 2 October 2020 via Microsoft Teams.

The online event would provide participants, particularly local government units in Luzon and energy stakeholders, an overview of the salient features of Republic Act No. 11285, or the Energy Efficiency and Conservation (EE&C) Act of 2019 and its Implementing Rules and Regulations (IRR). Signed into law by President Rodrigo Duterte on 12 April 2019, the EE&C Act aims to secure the country's energy supply by making EE&C a national way of life.

Other topics to be discussed during the two-day forum are local EE&C plan development, designated establishments, energy performance and labeling, certification for professional competency and accreditation for professional services, demand-side management, fiscal and non-fiscal incentives, and the updated Guidelines on Energy Conserving Design of Buildings.

DOE Senior Undersecretary Jesus Cristino Posadas and Department of Interior and Local Government Undersecretary for Operations and Energy Efficiency and Conservation Officer Epimaco Densing III are scheduled to deliver keynote addresses, while DOE-Energy Utilization Management Bureau Director Patrick T. Aquino will be delivering a presentation on the EE&C Act of 2019, its IRR, and other related programs and policy issuances.

With over 200 expected participants, the Forum is seen to be a major step that would help mainstream national EE&C policy for inclusive development in Luzon.

Applications for Nominated Areas in Offshore Mindoro and Recto Bank Basin

DOE Opens Applications for Nominated Areas in Offshore Mindoro and Recto Bank Basin

TAGUIG CITY- The Department of Energy <a href="https://doe.gov.ph">(DOE)</a>, through its Energy Resource Development Bureau (ERDB), opened the submitted applications for Nominated Area No. 5, located in Offshore Mindoro Basin, and Nominated Areas No. 6, 7 and 8, located at the Recto Bank Basin within the West Philippine Sea, under the Philippine Conventional Energy Contracting Program (PCECP) yesterday (14 September) at the agency's headquarters.

"As quarantine restrictions gradually ease, we actively welcome all PCECP applications that will help us maximize the exploration, development, and utilization of our indigenous energy resources to help us attain energy security and independence," Energy Secretary Alfonso G. Cusi said.

Three companies submitted applications, namely Troika Giant Power Corporation for Area No. 5; PXP Energy Corporation for Area No. 6; and Udenna Corporation for Areas No. 7 and 8.

All three passed the technical, legal, and financial "completeness check" conducted in yesterday's opening activity. The DOE-ERDB, together with the Technical Working Group composed of the DOE's Legal Services and Financial Services, will conduct further substantive evaluations of the proposals within fifteen (15) working days.

To help attain energy security, as well as cushion the country from the volatility of global oil price markets, the DOE established the PCECP to help reinvigorate petroleum exploration and development activities in the Philippines.

Full Electric Vehicle by Japanese Automobile Company

TAGUIG CITY- Department of Energy (DOE) Secretary Alfonso G. Cusi leads the test drive of the Nissan LEAF, a 100% full electric vehicle (EV), which the Japanese automobile company will be introducing to the Philippine market in 2021.

The test drive is being held at the Energy Center at Fort Bonifacio in Taguig City, where the DOE main office is located.

Joining Secretary Cusi are Nissan Philippines Inc. President Atsushi Najima, Electric Vehicle Association of the Philippines (EVAP) Chairman Rommel Juan, Energy Assistant Secretary Leonido J. Pulido III, DOE Energy Utilization and Management Bureau (EUMB) Director Patrick Aquino, and Nissan LEAF Specialist Cyrus Macasera.

Nissan has been one of the active proponents globally in the push towards the electrification of transportation, and for the realization of a zero-emission society.

Earlier, Nissan executives relayed to Secretary Cusi that the company is bringing the LEAF's EV technology to the country in support of the Duterte administration's vision of a safer, smarter and more sustainable future.

The DOE has been promoting EVs to reduce the country's reliance on petroleum as the transportation energy source. More than 30% of the country's energy requirement comes from the transport sector. With the advent of EVs, consumers are given more energy-efficient alternative to petroleum-fueled vehicles, allowing them to benefit from lower fuel and maintenance costs.

Retail Electricity Market Gains Ground Despite COVID-19

Retail Electricity Market Gains Ground Despite COVID-19

The Energy Regulatory Commission (ERC), in its 2nd Quarter 2020 Monitoring Report of the Retail Electricity Market, stated that it has granted a total of forty-two (42) Retail Electricity Supplier (RES) Licenses and authorized twenty-five (25) Local RES.  The said suppliers now compete for the supply of electricity of contestable customers in the Competitive Retail Electricity Market (CREM).  The CREM is where qualified contestable customers (those consuming 750 kW and above) have the option to choose their electricity provider, either from an RES or from a Local RES, the competitive business segment of a distribution utility (DU).

"The Commission has been regularly monitoring the activities in the Competitive Retail Electricity Market to observe the behavior of the stakeholders in this market, particularly in terms of pricing, switching patterns and the capacity and energy of contestable customers", said ERC Chairperson and CEO Agnes VST Devanadera.

The ERC's Monitoring Report further disclosed that as of the 2nd Quarter of 2020 total registered contestable customer issued with Certificates of Contestability by the ERC is at 2,089.  Out of the said number, 1,460 or 70% have entered into Retail Supply Contracts (RSC), which means that these qualified customers have decided to source electricity from a RES. The remaining 629 or 30% stayed with the regulated services of their respective DU.

From the total number of 1,460 contestable customers which have entered into RSCs, 1,120 or 77% are within the 1MW and above threshold, while 340 or 23% are within the 750kW to 999kW threshold.  Meanwhile, for the 629 contestable customers with Certificates of Contestability which have remained under the regulated services of their respective DUs, 328 or 52% are within the 1MW and above threshold, while 301 or 48% are within the 750kW to 999kW category.

In terms of market share, the total demand of all contestable customers as of the 2nd Quarter of 2020 is recorded at 4,977.31 MW.  Out of the said total demand, 81% are currently being served by an RES while the remaining 19% are still under the DU regulated service.

With respect to the suppliers in the CREM, the ERC's monitoring report further disclosed that majority or 55% of the ERC-licensed RES are affiliates of generation companies (GenCos) while 20% are also operating a generation company as another business segment. Meanwhile, 17.50% have no affiliations in the electric power industry whereas the remaining 7.50% are affiliated with Distribution Utilities (DUs).    Having more suppliers that are GenCo affiliated gives confidence that electricity supply is ensured and that they have the capability to offer competitive or cheaper prices in the CREM.  This is a positive indication which signifies that competition in the CREM is gaining ground and slowly breaking the monopoly in the supply of electricity by allowing more entities to act as a supplier.

As to the contestable customers' participation, the CREM registered an increase of almost 2% despite the Community Quarantine imposition in most of the areas in the country.  Although the contracted capacity of these contestable customers were reduced due to the impact of the pandemic on operations, the increase means that more contestable customers opted to enjoy the benefits of Retail Competition and Open Access (RCOA).

In terms of pricing, the ERC's evaluation revealed that eleven (11) RES have decided to offer lower rates for the quarter, while fourteen (14) RES have maintained their previous quarter's offer prices, and seven (7) RES have increased their prices.  Nonetheless, the overall price scenario for the 2nd Quarter showed a diminishing trend with a weighted average price of PhP4.12/kWh in April which decreased to PhP3.97/kWh and PhP3.95/kWh in May 2020 and June 2020, respectively. Such reduction in the weighted average prices manifests a strengthened competition in the CREM.

"The increased participation of contestable customers in the Contestable Retail Electricity Market and the diminishing trend in the prices being offered by Retail Electricity Suppliers is a silver lining in the midst of this COVID-19 pandemic.  This positive development stimulates competition among Retail Electricity Suppliers and will entice more contestable customers to shift to these electricity providers", ERC Chair Devanadera concluded.

No Free Covid Vaccine to Politicians

REP. LAWRENCE "LAW" H. FORTUN
Agusan del Norte 1st District
Member for the Minority,
Committee on Human Rights, Committee on Justice
One of House Authors, Crushing COVID-19 Act (HB 6865)
A lawyer by profession | Mobile number 09177292437

Mabuting ngayon pa lang magkaliwanagan na

NO FREE VACCINES, SPECIAL TREATMENT
FOR ALL GOVERNMENT OFFICIALS

[From division chief rank to highest-ranking in government]

Puro mahihirap ang barangay health workers at kasama sila sa vulnerable sectors, so dapat kasama sila sa free vaccines for the  20 million Filipinos.

(END)

Revised Guidelines for GenCos’ Financial Standards

ERC Invites Comments on the Revised Guidelines for GenCos' Financial Standards

The Energy Regulatory Commission (ERC), in a Notice issued in connection with ERC Case No. 2019-001 RM in re: Proposed Revised Guidelines for the Financial Standards of Generation Companies, sought the electric power industry participants' comments on the 2nd draft of the subject guidelines.  The proposed revisions to the guidelines seeks to update the 2005 promulgated guidelines to reflect the prevailing economic conditions and developments in the country's electric power industry.

"The Commission takes cognizance of the fact that we need to update our Rules and Guidelines to make them responsive and suitable to the prevailing conditions in the electric power industry.   A lot of developments have taken place in the power industry and the economic conditions now and fourteen (14) years ago, when the Guidelines for the GenCos' Financial Standards was promulgated, have a very huge disparity.  With the revised Guidelines we wanted to ensure that GenCos are financially capable to operate and produce sustainable electricity", ERC Chairperson and CEO Agnes VST Devanadera averred.

The Revised Financial Guidelines will set out the minimum financial capability standards to ensure that GenCos meet these standards in order to protect the public interest pursuant to the Electric Power Industry Reform Act (EPIRA) of 2001 and the Philippine Grid Code (PGC).  The subject Guidelines shall apply to all GenCos, including but not limited to: (i) Entities which own and operate a Generation Facility; (ii) Entities which own a Generation Facility that is operated by another entity under any management contract; (iii) Entities which hold a Capital Lease on generation assets; and (iv) Entities which hold an Operating Lease on generation assets.

The subject Guidelines also sets forth the documents that needs to be submitted for new and renewal of Certificate of Compliance (COC) applications, including the annual submission for the duration of the COC.

Comments on the Second (2nd) draft of the "Revised Guidelines for the Financial Standards of Generation Companies are advised to be sent both in hard and soft via email at licensing@erc.gov.ph.

We urge all interested parties to submit their comments on the "Revised Financial Guidelines" on or before 31 July 2020 so that any issues and inputs may be considered in the final version of the guidelines to be promulgated by the Commission", said ERC Chairperson and CEO Agnes VST Devanadera.

Philhealth Scam

REP. JOCELYN P. TULFO

"Whistleblower witness protection measures must be provided to Atty Thorrsson Montes Keith, the anti-fraud officer who has resigned from PhilHealth. The protection measures can be mounted by the National Bureau of Investigation or by civil society groups or institutions who can provide safe sanctuary," ani Tulfo.

"I ask Justice Secretary Menardo Guevarra to order the NBI to immediately take action, including proper investigation of the accusations the former PhilHealth anti-fraud officer has hurled at PhilHealth," pahayag ni Congresswoman Tulfo.

Hiniling din ni Tulfo sa Commission on Audit at Office of the Ombudsman na maglunsad ng sarili nilang imbestigasyon ayon sa kanilang mandato sa Konstitusyon.

"Preventive measures are also necessary, including specific orders to preserve documents and hold departure orders for if and when formal charges are filed," ani Tulfo.

"PhilHealth must also fully cooperate with all investigations on the graft and corruption allegations," aniya. (WAKAS)

Philippine OFW Remittances Drop

REP. FRANCISCO GAMBOA DATOL, JR.
SENIOR CITIZEN Party-list
Chair, Special Committee on Senior Citizens
Mobile number - 09177292437

"I appeal to the economic managers to save our OFW families from the economic impact of the pandemic now and in the coming months," ani Datol.

"OFW families need interest-free grants to enable them to start small businesses. PhilHealth must be ready to provide full coverage of OFW dependents and repatriated OFWs when they get sick for any reason," idinetalye ni Datol.

"Filipino families dependent on OFW remittances collectively lost P21.85 billion pesos last April when the money transfers from their breadwinners abroad dropped to $2.276 billion in April 2020 from $2.713 billion of April last year," ani Datol.

"The 16.1 percent difference is $437 million. P21.85 billion is the rough peso equivalent at an exchange rate of $1 to P50," paliwanag niya.

"If the official OFW remittances figures of the Bangko Sentral will show further declines in May, June, July and onwards, that would in turn mean more terrible suffering for millions of OFW families. For those on survival mode before the pandemic, they would fall deeper into poverty this year and probably until 2021," ani Datol.

"The real estate and housing sector and the banks and other financial institutions could also feel the burn of the drop in OFW remittances because of the resulting dampening of the purchasing power of OFWs, whose spending power had fueled acquisitions of new homes, condominium units, and motor vehicles," ani Datol. - posted at https://ph.mikeligalig.com

DOLE Cash-aid for Workers

REP. JOCELYN P. TULFO
ACT-CIS Party-list
Member, Committee on Social Services
https://www.facebook.com/jocelyntulfoinaction/ | 09177292437

MORAL OBLIGATION OF DOLE TO EXTEND CASH AID AND JOB-MATCHING ASSISTANCE TO ABS-CBN WORKERS DISPLACED AMIDST PANDEMIC

["Millions of  'Kapamilya' will hold us accountable for our words and actions here in Congress." – Rep. Tulfo]

Given the decision of the House Committee on Legislative Franchises to deny ABS-CBN Corporation's application for franchise renewal, I urge the Executive branch to immediately task the Department of Labor and Employment to extend cash aid and job-matching assistance to thousands of ABS-CBN workers who will be displaced due to the Philippines' biggest network's shutdown.

We must find ways to aid those thousands of employees caught in the crossfire of the legal dispute by facilitating their transfer to other existing networks or other competing firms in the same sector.

P5,000 X 11,000 workers = P55 million.

Considering the success of the Department of Finance in securing loans to augment our country's finances, distributing aid totaling P55 million to displaced workers should not be a challenge. So far, the DOF has secured at least $7.8 billion worth of loans and bonds.

I am neither a regular Member nor an ex-officio Member of the Committee on Legislative Franchises that is why I do not vote on any franchise application pending before the Committee.

The quest to push for the ABS-CBN franchise renewal is far from over. ABS-CBN supporters may continue to push for franchise renewal. What happened yesterday was not the end.

Members of Congress will have to contend with the political reality that ABS-CBN has a strong following among millions of Filipinos. They are Kapamilya.

The Kapamilya are not trolls. They are real people. There are millions of them and many of them are voters from whom we get our mandate to serve here in Congress.

The Kapamilya will hold us accountable for our words and actions here in Congress.

Some of us may have had their fleeting moments of fame and infamy.

That is the very real political reality on top of considerations of merit, fairness, and justice. (END) - https://news.mikeligalig.com

Couple on Motorcycle Riding During Pandemic

'Pag mag-asawa, di na kailangan ng "barrier"

SOLON OFFERS SUGGESTIONS ON HOW TO KEEP MOTORCYCLE RIDERS, PASSENGERS SAFE FROM COVID-19 https://ph.mikeligalig.com

[Rep. Alfredo Garbin asks for experts' opinion on that shield attachment; also asks IATF anew to allow back riding for other household members]

I thank the IATF for its formal decision soon to allow motorcycle back riding passengers for spouses and living in the same household of motorcycle drivers.

In my letter to the IATF last May 25, I enumerated the various ways proper safety protocols can be strictly observed. I put forth my stand addressing the issues and presented specific ways it could be done with strict implementation.

I appeal to IATF to consider also the motorcycle riders whose passengers are members of their own household are already in close physical contact even before they ride their motorcycle.

Since the IATF said it is open to suggestions, I present that instead of the motorcycle shield, both motorcycle driver and passenger wear any of the following sets of gear:

1.   Full face helmet with visor shield;

2.   Face shield and surgical face mask;

3.   N95 face mask and face shield;

4.   Face shield and protective eye shield; or

5.   Full-body personal protective suit

These options, I believe, offer ample protection against respiratory droplets and  pose less road accident hazards under different road and driving conditions.

Any of these options would be better than attaching that plastic shield with frame to the body of motorcycles.

My fear of serious and deadly road accidents from that shield attachment is real. The trade-off of risks is unacceptable.

Insurance premiums for motorcycles and riders should go up if that attachment is going to be used.

I suggest to the IATF that they consult automotive engineers and motorcycle safety experts on that motorcycle attachment and other proposed means to protect both rider and passenger, not just from COVID-19 but also from road accidents.

If they have expert opinion on the use of that shield attachment, I hope it comes from people like the motorcycle makers, engineers, and scientists who actually do research and experiments on moving vehicles, aerosol behavior, aerodynamics, and the physics of moving vehicles.  (END)

PAG-UWI NG LABI SA PINAS - https://ph.mikeligalig.com

OFWs NA NAMATAY SA COVID-19, PINABIBIGYAN NG MILITARY HONORS, BAYARIN SA PAGPAPALIBING, PINASASAGOT DIN

Francisco G. Datol, Jr.

"OFWs have been regarded as our modern-day heroes as they have made significant contributions to the Philippine economy and have sacrificed and toiled under difficult physical, emotional, social, and mental conditions abroad for the sake of their loved ones in the Philippines," paliwanag ni Datol sa kanyang resolusyon.

·     A flag-draped casket,

·     A vigil guard detail,

·     21-gun salute,

·     Taps, and

·     Defrayment of their funeral expenses

"It is the constitutional and moral duty of Congress to ensure that our OFWs get the proper recognition that they rightfully deserve for their distinguished service and sacrifices for our nation," diin ni Datol, Vice-Chairperson ng House Committee on Foreign Affairs. (END)

Tragic Jolo Shooting PNP vs Army

REP. JOCELYN P. TULFO
ACT-CIS Party-list

- More news at https://ph.mikeligalig.com

"If the PNP wants to save public trust in its organization, it would be wise for the PNP to keep its distance, practice ample physical distancing, but cooperate with the investigation," ani Rep. Tulfo.

"The NBI investigated. They filed murder, perjury, and planting of evidence charges against the PNP officer who shot dead former Corporal Winston Ragos. The NBI caught the police officer lying," ani Tulfo.

"The new PNP leadership is just months old with PNP Chief Archie Gamboa formally appointed last January," ani Tulfo. (WAKAS)

KINITANG INTERES NG DSWD SAP FUNDS NA NAKA-DEPOSITO SA BANGKO, DAPAT IPAMAHAGI RIN BILANG AYUDA
https://ph.mikeligalig.com

"Those are funds meant for the beneficiaries, not for anyone else, so they must be spent as intended in the Bayanihan To Heal As One Act", aniya. (WAKAS)

Senior Citizens in the Time of Pandemic

REP. FRANCISCO GAMBOA DATOL, JR.
SENIOR CITIZEN Party-list
Chair, Special Committee on Senior Citizens
09177292437 mobile number

(WAKAS)

Portable Satellite Technology Pushed

PORTABLE SATELLITE TECHNOLOGY, MABISANG SOLUSYON SA NAKAKAPIKON NA INTERNET SERVICE PARA MAIPATUPAD ANG ONLINE LEARNING, AYON SA MGA MAMBABATAS - https://pr.mikeligalig.com

Hinimok ng dalawang mambabatas ang IATF (Inter-Agency Task Force for the Management of Emerging Infectious Diseases) at iba pang mga ahensiya ng ehekutibo na mag-deploy ng satellite communications equipment para bumilis at lumakas ang internet signal sa bansa.

Mga VSAT at BGAN ang nais nina Iligan City Rep. Frederick W. Siao at Bohol 3rd District Rep.

"I suggest we deploy these equipment and accompanying devices again but this time, to make online learning work for over 32 million students (from kindergarten to college) and the 900,000-strong Department of Education," ani Rep. Siao, Vice-Chair ng House Committee on Information and Communications Technology.

"In a targeted way, BGANs can boost signals in areas where and when signals are weak, where there are blind spots, and where the cell towers are overwhelmed by high traffic volume. VSATs can be deployed to islands, foothills, mountain slopes, and other remote areas," dagdag ni Siao.

Ayon kay Tutor batay sa Speedtest Global Index nitong makaraang April 2020, "data transmission speeds in the Philippines are among the poorest in the world with the country ranking 121st out of 139 countries at 12.09 Mbps for mobile internet speed and 110th out of 174 countries at 21 Mbps for broadband internet speed."

Napuna rin ni Tutor na "meaningful usefulness of the Internet to Filipinos is limited because only a little over 4 million subscribers have broadband internet subscriptions at home, only 55%  have smartphones, and only a minority of 20% have laptops or desktop computers at home, according to various studies and authoritative sources."

Allowing airports and the airlines to resume flights under strict quarantine

Member for the Minority – Justice, Human Rights, and 14 other Committees

"I appeal to the IATF and DOTr consider allowing airports and the airlines to resume flights under strict quarantine measures for cargo, medical evacuations, relief operations, and mercy flights for stranded individuals," ani Fortun bilang panimulang mga hakbang.

"Limited airline operations would also somehow give hope to the tourism industries nationwide, including the airport concessionaires, the pasalubong outlets, the MSME sector, and the underground economy," paliwanag ng mambabatas.

"For all the airports, there really must be strict quarantine and screening protocols. We do not want a resurgence of COVID-19," ani Fortun. (END) - https://news.mikeligalig.com

Every moment counts. Any delay would cost lives," paalala ni Herrera.

"Human vaccine trials for COVID-19 are underway. With global efforts poured in, vaccines will be developed soon," ani Herrera.

Giit din ni Herrera, na isa ring Rotary Governor at may karanasan sa pamamahagi ng bakuna kontra naman Poliovirus, "Vaccines administered by government health personnel and hospitals shall be given free of charge, fully subsidized by government."

Dagdag pa ni Herrera: "Vaccines administered by government health personnel and hospitals shall be given free of charge, fully subsidized by government."

How to Covid Mass Testing in the Philippines

DISKARTE KUNG PAANO ISASAGAWA ANG MABILIS, SISTEMATIKO, AT MALAWAKANG COVID-19 TESTING SA BANSA, IDINETALYE

By Rep. Jocelyn Tulfo (ACT-CIS Party-list)
Mobile: 09177292437

Kakaapruba lamang po ng House Committee on Defeat COVID-19 yung P1.3 trillion economic stimulus for 2020, 2021, at 2022.

Tawagin natin itong - workplace oriented testing

Tawagain natin itong community-based testing

·      Public market at sidewalk vendors
·      Tricycle drivers, jeepney drivers at pedicab drivers

At syempre, during and after the test, may mga protocol na ipatutupad.

(WAKAS)

Para sa Manggagawa sa Araw ng Manggagawa - https://directory.mikeligalig.com

NEW MINIMUM WAGE POLICY IN HB 0668 TO COMPLEMENT BALIK PROBINSYA PROGRAM

In order for the Balik Probinsya strategy to effectively work, the Metro Manila-biased minimum wage policy needs to be replaced with a common minimum wage rate of P600 across all regions, both within and outside the National Capital Region.

The current minimum wage law has fueled and perpetuated the massive migration of our citizens from the provinces to Metro Manila. It runs counter to the espoused priority of creating economic growth in the countryside.

It is a policy based on the cost of living and token increases done by mere gradual  transfer of the cost of living allowance to the basic wage.

The current minimum wage policy is unfair to private sector workers because their counterparts in government are given wages based on a different set of policies.

What makes the difference in the pay among our government employees is the degree of responsibility and functions assigned to the employee, and not the place of assignment. And yet, for our workers in the private sector, their minimum wages are simply determined by the place or area where they work.

One thing the COVID-19 crisis has clearly exposed is how unfair this policy of different minimum wages - the health risks faced by frontline workers in Metro Manila are the same with those faced by frontline workers in the provinces, and yet they are paid differently.

It is time to DISCARD the current minimum wage policy and replace it with what I have proposed in House Bill 0668.

HB 0668 seeks to set a national minimum wage of P600. On top of this national minimum wage, the existing National Wages and Productivity Commission (NWPC) and the Regional Tripartite Wages and Productivity Boards (RTWPBs) shall determine incentives and other productivity improvements to the wage earners within a region when still necessary.

This measure will help our fellow Filipinos keep up with inflation or the increase in the general price level of goods and bring them closer to a humane standard living for all, especially to the lowliest and unprotected members of the workforce, by providing them real wage gains. (END)

NTC stops ABS-CBN operations

REP. LAWRENCE "LAW" H. FORTUN
Agusan del Norte 1st District
Member for the Minority
Co-Author, HR 639 supporting the renewal of ABS-CBN Franchise

HOUSE RESOLUTION CONDEMNING THE NTC's CDO vs ABS-CBN

LAWMAKER SUPPORTING ABS-CBN FRANCHISE APPEALS TO HOUSE PANEL TO MOVE FRANCHISE BILLS FORWARD

Agusan del Norte (1st District) Rep. Lawrence Fortun has formalized his condemnation of the action of the National Telecommunications Commission by filing the still unnumbered House Resolution.

A RESOLUTION CONDEMNING THE ISSUANCE BY THE NATIONAL TELECOMMUNICATIONS COMMISSION OF A CEASE AND DESIST ORDER AGAINST ABS-CBN IN WANTON DISREGARD OF ITS COMMITMENT TO BOTH HOUSES OF CONGRESS TO GRANT THE BROADCASTING NETWORK A PROVISIONAL AUTHORITY TO OPERATE PENDING RENEWAL OF ITS FRANCHISE

Fortun said he filed the resolution because he strongly believes the House of Representatives has to officially express its sentiment on the contemptuous act of the NTC that is effectively a brazen mockery of both houses of Congress.

Fortun also said, "This is lesson learned for the House of Representatives. Had the House acted on the franchise renewal bills early on and passed the necessary legislation, this would not have reached this point where the decision to allow the continued operation of the network had been placed in the hands of a disingenuous Commission.

We have been misled by an agency led by people that have no qualms about wantonly disregarding a commitment made under oath in official proceedings of both the Senate and the House of Representatives.

Now that the NTC blatantly reneged on its commitment, the Committee on Legislative Franchises, consistent with its expressed intent to allow the continued and unhampered operation of ABS-CBN, has to act expeditiously, consolidate the franchise bills and approve a substitute bill.

As to the quo warranto petition filed by the Solicitor General, the same may already be dismissed by the Supreme Court for being moot and academic. The petition seeks to revoke ABS-CBN's franchise, and technically, there is no franchise to revoke anymore, the same having expired already.

The argument, however, that new bills will have to be filed because there is nothing to renew anymore does not hold water.   The pending bills provide not for renewal of franchise, but simply, grant of franchise.

Please see attached copy of the resolution. (END) - https://pr.mikeligalig.com

Human vaccine trials for COVID-19 are underway

FUNDS FOR COVID-19 VACCINES MUST BE READIED IN ADVANCE

·      Earmark gov't funds as early as now
·      Get ready to purchase vaccines once developed
·      Human vaccine trials for COVID-19 are now underway

National and local governments ought to be ready with the funds needed to procure ample supplies of the vaccines against COVID-19 as soon as the vaccines become widely available.

Dapat ngayon pa lang mag-earmark na ang ating gobyerno ng pondo para sa bakuna, para as soon as  ma-develop ang bakuna may pambili agad. Every moment counts. Any delay would cost lives.

Human vaccine trials for COVID-19 are underway. With global efforts poured in, vaccines will be developed soon.

Vaccines administered by government health personnel and hospitals shall be given free of charge, fully subsidized by the government.

However, the vaccines bought by private hospitals and private doctors would likely be at a cost although with partial PhilHealth cover.

This is the prudent course of action toward ensuring that residents and visitors are protected against the coronavirus.

We must ensure the vaccines are given to every person who must be vaccinated.

We leave the scientific details and vaccine protocols to the experts on vaccines, but funding and procurement for public use are the purview of government. (END) - https://news.mikeligalig.com

LAWYER-SOLON LAYS DOWN REASONS TO ALLOW LONE ‘BACK RIDER’ ON MOTORCYCLES

AKO BICOL PARTY-LIST
REP. ALFREDO A. GARBIN, JR.
Vice-Chair, Committee on Justice
Member, Committee on Transportation
09177292437 | Twitter @AlfredoGarbin

LAWYER-SOLON LAYS DOWN REASONS TO ALLOW LONE 'BACK RIDER' ON MOTORCYCLES

If the IATF will continue to allow motorists to have passengers within their privately-owned SUVs, cars, and utility trucks under GCQ and lifted quarantine conditions, then they must also allow motorcycle riders to have one back riding passenger.

EQUAL PROTECTION
The constitutional basis of this position is the equal protection provision of the 1987 Constitution. This equal protection of law covers life, liberty, and property, as well as livelihood.

There are 7.2 million registered motorcycles and millions of Filipino families who are dependent on motorcycles as their personal means of transportation

The logic behind the prohibition appears to be inapplicable to couples and immediate family members because family members reside in the same house. The perceived benefit of social distancing does not exist in a household, wala naman social distancing ang isang pamilya sa kanilang tahanan.

Kung hindi sa kanila applicable ang reason ng prohibition, perhaps it would be appropriate for the IATF or the DOTr to modify the prohibition on back riding by allowing family members to back ride.

If the IATF will continue to discriminate against motorcycle riders, there would probably be legal challenges brought before the Judiciary in the weeks and months ahead. (END)
